Terms of Use of the katalog.pbspolska.eu Website

Chapter I — General Provisions, Definitions

1. The owner of the katalog.pbspolska.eu website is PBS Connect Polska Sp. z o.o. (hereinafter referred to as the “Website Owner” or “Owner”).

2. These Terms of Use define the manner in which the Users may use the katalog.pbspolska.eu website (hereinafter referred to as the “Website”) and shall be available at katalog.pbspolska.eu in such a manner that the User may, prior to the use of the services, obtain, reproduce, record and store (including in the ordinary course of business) the content of the Terms of Use, by means of the ICT system they use.

3. “User” shall mean any person over 18 years of age with full legal capacity, a legal person and an organisational unit without legal personality but with legal capacity, who even only visits the katalog.pbspolska.eu site and has accepted these Terms of Use.

4. Before using the Website, the User shall be obliged to read the Terms of Use. By using the services of the Website, the User acknowledges that they have read these Terms of Use, as well as that they accept and undertake to comply with them.

5. “Products” — whenever Products are referred to in these Terms of Use, it shall mean the items available on the Website.

6. “Customer” — whenever the Customer is referred to in these Terms of Use, it shall mean a User who purchases Products on the Website.

7. “Commercial Information” — information containing descriptions of the Products and their images, in addition to information on the prices of the Products and their availability. Commercial Information is also any information meeting the definition of commercial information contained in Article 2(2) of the Act of 18 July 2002 on Providing Services by Electronic Means.

8. “Loyalty Programme” — whenever a Loyalty Programme is referred to in these Terms of Use, it shall mean a programme offering the possibility of exchanging Loyalty Programme Points for prizes specified in the Loyalty Programme Terms.

9. “Loyalty Programme Points” — whenever Loyalty Programme Points are referred to in these Terms of Use, it shall mean points awarded to a Customer in accordance with the Loyalty Programme Terms for placing and paying for an order for a given Product, collected in that Customer’s Account, which may be exchanged by that Customer for prizes.

Chapter II — Type and Scope of Services Provided by the Website

1. The Website collects orders for office supplies.

2. All Products available on the Website are brand new and free from physical and legal defects.

3. All prices quoted on the Website are net prices. Gross prices are shown in the order summary.

4. PBS Polska Sp. z o.o. shall issue VAT invoices for all Products sold on the Website.

5. Payment options are bank transfer, credit card, and cash (upon collection).

6. Order lead times depend on delivery details and type of order. The standard lead time is up to 48 hours.

7. Delivery of the Products is made via a logistics operator. The Website shall not be held responsible for delays in delivery caused by delivery services.

8. The Website shall bear delivery costs for orders of net PLN 1,600 after discount and above. In other cases, delivery costs shall be borne by the Customer in accordance with the delivery price list.

9. In the event of non-conformity of the Products with the contract, the Customer should make a complaint using the contact form. The complaint should include description of the nature of non-conformity and the expectations towards the Website.

10. The Website shall respond to the complaint within 14 days. If the case requires an expert’s opinion, the deadline for responding to the complaint shall be 30 days. The complaint shall be deemed justified after the expiry of this deadline and in the absence of a response from the Website.

11. In the event that delivery of a defect-free Product is required for fulfilment of the Customer’s request, the delivery costs shall be borne by the Website.

12. In fulfilment of the obligation imposed by Article 9(1)(6) of the Act of 2 March 2000 on the Protection of Certain Consumer Rights and on the Liability for Damage Caused by a Dangerous Product (Journal of Laws of 2000, No. 22, item 271, as amended), the Website informs that the consumer may withdraw from the contract without stating reasons within ten days of delivery of the ordered Products. To exercise this right, the Products should be sent back together with a written declaration of withdrawal from the contract to PBS Connect Polska before the expiry of a period of ten days from their delivery.  The Customer should indicate the bank account to which the money should be returned. Returned Products shall be accepted if they are in their original, undamaged packaging and if they bear no signs of use. The Products shall be sent back at the expense of the Website. The Website checks the returned goods within 7 days.

13. The Website range is created on the basis of the commercial information referred to in item 8 of the Terms of Use. The Website makes every effort to keep product descriptions, functional parameters, photographs and prices up to date. At the same time, the Website informs that the prices of the Products may change, and to become certain of the current price, before placing the order the Customer should contact PBS Polska Sp. z o.o. at +48 22 243 00 40.

14. The date of conclusion of the sales contract shall be the date of delivery of the ordered Products to the Customer.

15. Any Customer who logs on to the Website may participate in the Loyalty Programme. Loyalty Programme Points can be assigned to Products. By making purchases on the Website, the Customer collects Loyalty Programme Points in their account, which can be exchanged for prizes in accordance with the Loyalty Programme Terms.

16. Pursuant to Article 15 of the Act on Providing Services by Electronic Means, the Owner shall not be obliged to check the data it transmits, stores or makes available. However, the User or a third party shall have the right to report that the data or the related activity in their opinion is unlawful via the contact form.

Chapter III — Terms of Service

1. To be able to use the services of the Website, the User must have a computer system meeting the following minimum technical requirements:

1. an Internet connection;

2. any operating system with a web browser;

3. JavaScript enabled and acceptance of cookies by the web browser.

2. The Website Owner informs that the data transmission between the User’s computer and the websites is not of a confidential nature and may be subject to interference by third parties (viruses, spam, etc.). To avoid interference by third parties, the User should ensure that their computer is protected against malware and has up-to-date anti-virus software and other such security features.

Chapter IV — Website Technical Breaks, Failures and Errors

1. The Website Owner undertakes to make every effort to ensure the correct and uninterrupted functioning of the Website. In the event of malfunctions and technical errors due to hardware or software problems or other reasons, the Website Owner shall endeavour to limit the negative effects of the technical problems to the greatest extent possible. The Website Owner shall not be liable for the consequences of technical failures if they result from events which it could not have foreseen or prevented with due diligence.

2. Information on technical breaks, failures and technical errors is posted on katalog.pbspolska.eu

3. To further development of the Website and minimise the risk of failure, periodic technical breaks are necessary, during which appropriate changes are made to the IT system. Whenever possible, the Website Owner undertakes to plan for technical breaks to take place during the night, so that they cause the least inconvenience to Users.

Chapter VI — Copyright

1. The Users undertake to use the services of the Website in accordance with the Copyright and Related Rights Act of 4 February 1994 (consolidated text: Journal of Laws 2006, No. 90, item 631) and the Industrial Property Law Act of 30 June 2000 (consolidated text: Journal of Laws 2003, No. 119, item 1117).

2. The entire content of the Website pages is protected by copyright and industrial property rights in favour of the Website Owner.

3. The User may not copy data from the Website pages, except for permitted private use or with the prior written consent of the authorised entity. Commercial use of the information on the Website, including in particular product images or descriptions, is illegal.

Chapter VII — Final Provisions

1. The Website Owner shall have the right to change the Terms of Use and undertakes to inform the Users via katalog.pbspolska.eu of changes to the Terms of Use. These changes shall enter into force 14 days after their publication and shall be clearly presented during this period so that the User can notice them without having to carefully read through the entire Terms of Use.

2. The provisions of generally applicable Polish law, and in particular the provisions of the Civil Code Act of 23 April 1964, the Personal Data Protection Act of 29 August 1997, and the Act of 18 July 2002 on Providing Services by Electronic Means shall apply in all matters not governed by these Terms of Use.

3. Any disputes between the Parties shall be settled by the competent common court.

4. These Terms of Use shall enter into force on 08/10/2013 with Chapter V — Personal Data Protection effective from 25 May 2018.
